• Autonomous Drone Intelligence platforms
• Defence Intelligence Platform for command and control
• Related software, APIs, dashboards, and documentation

The specific features, capabilities, and terms of any product or service engagement will be defined in a separate Service Level Agreement (SLA) or Statement of Work (SOW) between you and Tosh Defence.

4. User Accounts & Access

Certain features of our Services may require you to create an account or obtain access credentials. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your login credentials.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.

5. Intellectual Property

All content, technology, software, algorithms, designs, trademarks, logos, and other intellectual property associated with Tosh Defence and its Services are owned by or licensed to Tosh Defence and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services strictly in accordance with these Terms. You may not:

• You will not disclose confidential information to third parties without our prior written consent.
• You will implement reasonable security measures to protect any data or credentials provided to you.
• Any feedback, suggestions, or improvements you provide regarding our Services may be used by us without obligation to you.

7. Prohibited Uses

You agree not to use our Services to:

• Violate any applicable law, regulation, or international treaty.
• Engage in activities that threaten national security or public safety.
• Interfere with or disrupt the integrity or performance of our Services.
• Attempt to gain unauthorized access to any part of our systems or networks.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Tosh Defence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of, or inability to use, our Services.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount paid by you to Tosh Defence in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. Tosh Defence expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tosh Defence and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your use of our Services or violation of these Terms.

11. Termination

We may terminate or suspend your access to our Services at any time, with or without cause and with or without notice. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, limitation of liability, and indemnification provisions.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

Before pursuing formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of at least thirty (30) days.
